Earlier this month it was reported that Northern UK real estate agency, Gascoigne Halman, had left OnTheMarket and returned to Zoopla. However PropertyIndustryEye is reporting that Gascoigne Halman has backtracked and returned to listing on OnTheMarket (OTM).
The move follows legal action by OnTheMarket making clear its determination to enforce its contracts and have its ‘one other portal’ rule upheld.
PropertyIndustryEye reports it understands the matter is not concluded and talks are ongoing.
Gascoigne Halman was an early Gold member of OTM. The company signed up to the OTM site's "one other portal" rule, making Rightmove its second choice.
Earlier this month, however, the firm told PropertyIndustryEye its acquisition by Connells – a stakeholder in Zoopla – meant that its departure from OTM was inevitable.
Other stakeholders in Zoopla include LSL property Services and Countrywide – although the latter has recently halved its holding.
“When it was announced that Gascoigne Halman was listing its properties on Zoopla/PrimeLocation as well as on Rightmove, we initiated appropriate legal action to address the situation,” an OTM spokesperson tells PropertyIndustryEye.
“Gascoigne Halman remains a valued member of Agents’ Mutual and is complying with its contractual agreements to pay a monthly subscription fee and to list its properties at OnTheMarket.com and a maximum of one other portal, which continues to be Rightmove.”
PropertyIndustryEye says the Connell Group is currently in discussions with OTM and Zoopla but it could not issue an update. Gascoigne Halman declined to comment.
The action sets a precedent for other agents considering breaking their advertising agreement with OnTheMarket.
