The Spanish Association of the Digital Economy (Adigital), an entity formed by more than 500 associates whose objective is to promote and support the digital economy in Spain, has celebrated this week the advances of the Italian government in relation to the regulation of the work model of digital platforms.

The Italian government approved a Decree Law in which it defines the status of professionals who offer their services through digital delivery platforms, and the obligations of these companies in their relationship with their riders.

Of this Decree, which has led the 5 Star Movement (M5S), it emphasizes that it recognizes the existence of a non-subordination relationship between the professional and the platform, and that it establishes a series of requirements for the company estimating the independence and flexibility that characterizes the model.

Specifically, the regulations require the platforms to offer mandatory public insurance to their riders (INAIL) to increase the protection and guarantees of workers in the event of accidents or occupational diseases.

Likewise, it establishes a guaranteed minimum hourly wage for distributors, whose amount is not determined and which will be conditioned on the delivery of the order, at least, one hourly order.

Adigital believes that the Italian legislation has advanced towards an innovative fit of relations between digital platforms and users according to their particularities on independence, protection and freedom to provide the service, becoming a new reference in this area.

For the association, the decision of the Government of Italy to take a step forward in this regard, as has already happened in France, is new evidence of the importance of rethinking the work model to adjust it to the new realities. Nor does the parallel progress of both countries seem coincidental, with which the normative proposal in terms of work on digital platforms that Adigital presented only a few weeks ago is aligned.

“It is necessary to provide legal certainty to all parties (company, users and service providers), and we believe that the way to achieve this is to promote a regulation that confirms that the professionals who operate through platforms are framed in the Special Scheme of Workers Autonomous (RETA) and the dowry of greater coverage, such as protection against health contingencies or the cessation of professional activity,” recalled José Luis Zimmermann, General Director of Adigital.

“The French case is paradigmatic and now that of Italy joins it, so that our country, which is at the forefront in the volume of employment on digital platforms, can no longer delay the revision of current regulations. Therefore, we encourage the creation of a work table, as has happened in these other countries, and open the debate with all the agents involved to set up an innovative, competitive and guarantee system for companies, users and service providers,” demands Zimmermann.
